Terms & Conditions Agreement


Please stop and take a few minutes to read this agreement carefully. By participating in this Trade-up program you agree to assume the obligations outlined below. It is your responsibility to read this agreement carefully to understand your obligations.

You must be 18 years old or older to participate in this program. By agreeing to these terms and conditions, your are agreeing that you are 18 years old or older and eligible to participate in the Nokia Trade-up program.

Nokia's Trade-up program is operated by an independent third party, Dealtree Services Inc. and other service providers selected by Dealtree Services. Dealtree Services and its service providers are referred to in this agreement as "Dealtree." This Trade-up program is not owned, run or managed by Nokia and all transactions conducted through this Trade-up program and Dealtree are solely the responsibility of Deatlree and such visitors. By participating in this program, you release Nokia and its respective directors, employees and agents from any disputes, claims, demands and/or damages (actual or consequential) of any kind, whether known or unkown arising out of, or relating to, your use of Dealtree's services including, but not limited to, incomplete or completed transactions.

You agree to the terms and conditions set forth below by Dealtree regarding the Trade-up offer. In these terms and conditions, the mobile phone(s) you are trading up is referred to as the "Item."

1. In order to participate in the Nokia Trade-up program, you must purchase a new Nokia device from one of Nokia's authorized carriers, channel partners or retailers. Refurbished products and/or products purchased from unauthorized resellers do not qualify as a new Nokia purchase.

2. This program applies to purchases made as early as thirty (30) days prior to the date of your quote. It also applies to purchases made after receiving the quote as long as your old items and proof of purchase for your new item are received at Dealtree's Trade-up Center within thirty (30) days from your quote date.

3. You agree to provide the original proof of purchase for the qualifying new Nokia mobile device purchase. You agree that if you do not provide this proof of purchase you will not receive the Trade-up value. Dealtree will email you to remind you to send in your proof of purchase but if it is not received within 30 days from the date of your quote you will not receive your Trade-up check. Dealtree will give you the option of shipping your phone back to you at your expense or will keep the phone.

4. You are the only owner of the Item and have the right to transfer ownership of the Item. No other person or company has any ownership interest of any kind in the Item.

5. The Item description and model number you provide are accurate and complete. The serial number and/or IMEI number on the Item is original and has never been tampered with.

6. You are providing the Item to Dealtree in working order. You are responsible for the condition of the Item upon its arrival at Dealtree's facilities. If the Item does not work when it arrives at Dealtree's facilities, you agree to pay for the shipping costs necessary to return the Item to you.

7. Upon receipt of the Item and the proof of purchase for the qualifying new Nokia mobile device, Dealtree will inspect the Item to determine the Item's valuation. If Dealtree accepts the item, Dealtree will provide to you a check in the amount of the Valuation selected by Dealtree. THE VALUATION MAY BE SUBSTANTIALLY DIFFERENT THAN THE ORIGINAL ESTIMATE PROVIDED TO YOU. YOU AGREE THAT DEALTREE'S VALUATION OF THE ITEM AFTER DEALTREE RECEIVES THE ITEM IS FINAL.

8. When you place a Trade-up order or when you receive confirmation from Dealtree that you have placed a Trade-up order, Dealtree has not agreed to actually perform the Trade-up. Dealtree's acceptance of your Trade-up order only occurs when Dealtree sends you an email with the final verification of your Trade-up value. You acknowledge that Dealtree may reject any Item for any reason and may limit the quantity of Items to be traded up.

9. Upon receipt of the Item by Dealtree, all information, data and software on the Item will be deleted and unrecoverable.

10. If Dealtree is damaged or incurs any kind of expense because you were not authorized to transfer ownership of the Item, because of the condition of the Item, or because of any software or other information stored on the Item, you agree to defend, indemnify and hold Dealtree harmless from any liability, claim, or expense associated therewith.

11. If Dealtree accepts the Item, you transfer all right, title and interest in the Item to Dealtree. Your transfer of the Item to Dealtree may not be revoked by you.

12. YOU AGREE THAT DEALTREE WILL HAVE NO LIABILITY TO YOU IF THE VALUATION YOU RECEIVE IS LESS THAN THE ESTIMATE INITIALLY PROVIDED TO YOU, IF DEALTREE REJECTS ANY ITEM, OR IF THE ITEM IS LOST OR DAMAGED DURING SHIPPING.

13. These terms and conditions may be amended at any time by posting the terms on this site.

14. You agree that the only location for any legal action between you and Dealtree will be the state or federal courts located in Orange County, California.
